JSW Cement Wins Orissa High Court Case on SGST Reimbursement

JSW Cement Ltd has won a significant legal battle against the State of Orissa. The Hon'ble High Court of Orissa, Cuttack, ruled in favor of JSW Cement in a writ petition concerning reimbursement of incentives under the Industrial Policy Resolution, 2015 (IPR 2015). The court set aside the amendment dated August 18, 2020, which retrospectively excluded cement units from SGST reimbursement. JSW Cement will be treated as having obtained deemed approval for Priority Sector status and is directed to receive its SGST reimbursement claim, along with applicable interest, within four weeks. This judgment upholds the company's claim for benefits under the IPR 2015, reversing a retrospective exclusion that impacted its SGST reimbursements.
