
Mukka Proteins Wins CESTAT Appeal, ₹15.24 Cr Duty Demand Set Aside
Mukka Proteins Ltd has received a final order from the Customs, Excise & Service Tax Appellate Tribunal (CESTAT), Bangalore, setting aside a demand of ₹15,24,30,536. The litigation involved the valuation of imported fish meal between September 2014 and October 2015. The Customs Department had alleged undervaluation and misdeclaration, leading to a Show Cause Notice. After an initial order was set aside and remanded, the Commissioner of Customs, Mangalore, reconfirmed the demand. CESTAT, in its final order dated June 24, 2026, ruled that the department failed to establish undervaluation with cogent evidence, thus setting aside the customs duty, interest, redemption fine, and penalties. The company may also be eligible for a refund of ₹75,00,000 previously appropriated.
